The dual citizenship claims, I believe, come from his adoption by Soetoro and it would be Indonesia not Kenya. Also, at the time of the adoption, the original birth certificate would be null and void and the new BC would be issued with Soetoro in the father’s box. This should be the BC on file unless at some time later, Obama or his guardian petitioned the court to have it declared void and legally changed his name again.

It doesn’t necessarily have anything to do with eligibility, just getting the facts correct.

Unilateral disarmarment in terms of nuclear weapons, along with assurances from other countries and terrorist organizations that they also will some day disarm will be the second priority of the first Barack administation. Rumors are always around, but most people I know don’t give rumors weight in and of themselves. There are lots of mysteries in Obama’s past when you start asking questions of what he has written and what he has “pooh-poohed.”

Obama’s campaign would find its legs if he spent some of his money on an honest effort to bring forth the facts and own up to them. He might lose, but he would at least be thought honest which is a character trait that people look for in order to grant any measure of trust.

Myself, I think the thing that has him hemmed in is that he is still attached to Alinsky’s powerful and explicit blueprint for how to achieve political power. Alinksy is bold-faced as to what it takes to herd the middle class into a voting block and the ends always justify the means. He was a student of Machievelli who made this point: “It is necessary for a prince, who wishes to maintain himself, to learn how not to be good, and to use this knowledge, and not use it, according to the necessity of the case.” (The Prince and the Discourses, p.56.) (I might add that Hillary also was attracted to Alinsky and wrote her thesis on his methods. She gets into the same problems as Obama. It’s this constraint that keeps both of these people from being on the level.)

Practicing this is causing Obama’s problems and he is afraid to abandon this practice knowing that the American people won’t want his real values and purposes. I assert that Obama, who has spent a lot of years in the practice of Alinksy’s methods, believes that those methods are The Way, not A Way.

This Selective Service and “closet Muslim” stuff is nothing more than background noise. Here is what needs to be investigated:

The Obama team posted a fake Hawaiian Certificate of Live Birth (COLB) on the campaign’s official “Fight the Smears” website. Why a fake? What is on the original COLB Obama doesn’t want us to see? This incident alone is extraordinary. A faked government document on Obama’s official website?

Several digital document experts claim to have uncovered the original name on the COLB- Maya Kassandra Soetoro, Obama’s half-sister. This is peculiar since Maya was born in Indonesia, not Hawaii. Since Hawaiian law allows only immediate family members access to birth documents, the COLB (issued in June of 2007) almost certainly came from the hands of Barack or Maya. How did Maya get her COLB if she was born abroad?
Barack’s mother split up with Barack Obama Sr. in the early 60’s. Nobody knows for certain whether the two were ever married. Obama’s mom re-married, and he was adopted by an Indonesian national, Lolo Soetoro. The family moved to Indonesia for several years. Barack first attended a Catholic school for 2 years. This school’s registration lists his name as “Barry Soetoro” and his nationality as “Indonesian”. Is it far-fetched to think Obama established Indonesian citizenship as a youngster? He and his mother changed their names to Soetoro. He moved to Indonesia. The school certainly believed he was Indonesian.
Here’s my take. Obama is concealing his original COLB because it lists him as Barry Soetoro (remember he changed his name at the time of adoption). He has (or had) dual American/Indonesian citizenship. He is worried this dual citizenship will violate Constitutional statute, making him ineligible for the presidency.

Begin. Investigating. Now!!!!!!!

These rumors about Obama are silly. It just makes our side look bad to be pushing this crap. Obama’s claim to be a natural-born citizen is stronger than McCain’s for heaven’s sake. The last thing we need to do is be focused on attacking Obama’s constitutional qualifications for the presidency.

By the way, the presidency is a constitutional office whose qualifications are set forth in the constitution. Congress can’t add new qualifications. So, the Selective Service Act would likely be found unconstitutional as applied to any attempt to bar Obama from being President based on an alleged failure to register (even though it’s clear he did register).

Enlistment into the U.S. Navy, or any branch of the U.S. military, by citizens of countries other than the United States is limited to those foreign nationals who are legally residing in the United States and possess an Immigration and Naturalization Service Alien Registration Card (INS Form I-151/551 — commonly known as a “Green Card”). Applicants must be between 17 and 35; meet the mental, moral, and physical standards for enlistment; and must speak, read and write English fluently.
Note: The U.S. military branches cannot assist foreign nationals in obtaining admittance into the United States. Questions concerning immigration to the United States should be asked of the U.S. Embassy. Only after immigration procedures are completed and an applicant is legally residing in the United States may an application for enlistment be accepted.
Furthermore, in order to be commissioned an officer in the U.S. Navy, one must be a native-born or naturalized United States citizen.

In July 2002, President George W. Bush signed an executive order specifying that foreign nationals who serve in the United States armed forces during a period of hostility would be eligible for expedited U.S. citizenship. The period of hostility began on September 11, 2001, and ends on a date that has yet to be specified by the President.

According to the White House, this executive order has allowed non-citizens to immediately become U.S. citizens. So far, more than 13,000 foreign-born members of the armed forces have applied for U.S. citizenship since the order took effect.

For those foreign nationals who are stationed overseas, the Immigration Services now allows naturalization ceremonies to be held at U.S. military bases, embassies, and consulates around the world. This makes it easier for the foreign-born military personnel to obtain their citizenship quickly.

Under current immigration laws, non-citizens must serve in the U.S. military for at least one year before they are eligible to apply for citizenship. This new executive order, however, will remove the three year service requirement. Additionally, the filing fees associated with an application for naturalization will be waived for those meeting the above-mentioned requirements.

A survey released in May 2006 indicated that there are more than 68,000 foreign-born serving in the armed forces, and this represents approximately 5% of the total on active duty.

He was born in Hawaii after it was a State, so that takes care of that. He was illegitimate, which the orig. birth certificate probably indicates, can’t blame him for not wanting to admit that. Even if BO, Sr. did participate in some faux marriage ceremony, BO would still be illegitimate since his father was already married and would therefore be a bigamist.

If, as alleged, he was adopted by Lolo Soetoro, he would have had a new birth certificate and a new name and attained dual citizenship thru his adoptive father.

It is all only interesting because BO has made it all so hush hush and used a phony birth certificate that has raised suspicions.

But the bottom line isn’t eligibility, it is electability and the man is not qualified to lead this country, especially in these perilous times.

My suggestion: He go take some classes in American History and learn about this country and then try again in 8 or 12 years. That and try to clear his mind of all the propaganda and garbage Wright, Ayers, Pfleger, Cone, Davis, Michelle, and the rest have filled it with.

Mr. Obama has produced no legal evidence of his being born in Hawaii, despite what this silly article says. I have no particular reason to believe that he was born elsewhere, other than his repeated lies about nearly everything else [but, hey, he's a politician; you know that such folks are lying when their lips move].

The unsettling part is that this issue, if indeed it is one, is ridiculously easy for Mr. Obama to lay to rest. All he needs to do is to provide the Federal Election Commission with a certified paper copy of his Hawaii birth certificate. The fact that he has not done so is driving the rumor mill.

And, Mr. Owens, the Constitutional requirement that he be a natural-born citizen is not what I would term a technicality. If you do not like the Constitutional provision, fine: make an effort to get rid of it. in the meantime, it is the highest law in the land. Live with it.

Mr. McCain is not without his own troubles with respect to being a natural-born citizen. The opinions of lawyers are quite irrelevant: it is the opinion of judges that matter.

I find it interesting that Obama is always making statements accusing McCain, the GOP, and the right in general of creating and spreading vile and or racist rumors to make voters fear him, but when the source of most of said rumors is traced it’s usually some leftist who’s responsible. When effective arguments to refute the rumors are made, not the cryptic, legalistic denials and “they’re all just nazi Republican bigots” bs usually offered by the Obama campaign, but determined efforts to expose as much truth as possible, those arguments most often appear on sites like this one, NRO, and other supposed members of the “vast rightwing conspiracy”.
I’m not ordinarily a proponent of the conspiracy theory of history, but it must be remembered that the tactic of subjecting oneself to phony assaults to elicit sympathy and demonize one’s opponents is one the left has used effectively and often for some time. Another point to remember is that the original meaning of the word sinister is left.

It simply IS NOT THERE! (Obama’s campaign HAS NOT released anything…and the one “Certificate” on the web, since taken down, btw, has been proven to be a fake 6 ways from Sunday.)

In fact, we don’t even know FOR CERTAIN which of 2 hospitals he was supposedly born at in Hawaii!
NO DOCUMENTATION has been released by the Obama campaign regarding this.

I’m not harping on this to make a point of his being ineligible for POTUS…he “may” have been born in Hawaii and “may” be a citizen after “renouncing” his possible Indonesian citizenship…it STILL remains a question even though he IS totally UNQUALIFIED to be the President, of which there is NO question there!

So the ONLY real FACT is: We just do not know!

And the question becomes:

WHAT IS HE HIDING????

Obama can simply lay ALL these rumors to rest by releasing the ACTUAL original signed BC, OR the one after Lolo Soetoro adopted him…but he does not!

You can skip over this “rumor” like it is all a forgone conclusion, like you did, and that is EXACTLY what Obama hopes you will do…but some of us would like to know FOR A DOCUMENTED CERTAINTY:

So the German’s declared war several days after Dec. 7, 1941, big deal, they were no threat to the continental U.S.A. and it was all a bunch of provocative posturing, right?

Historical facts are such a stubborn thing, and the anti-war liberal historical dialectic is such a joke … well, you can see what happens when the left’s bogus dialectic is applied consistently to one of their own icons … FDR.

Stafford, Va. – Osama bin Laden must be chuckling in his safe house. After all, the 2008 campaign could very well give Al Qaeda the ultimate propaganda tool: President Barack Hussein Obama, Muslim apostate.
The fact that Senator Obama – the son of a Muslim father – insists he was never a Muslim before becoming Christian is irrelevant to bin Laden. In bin Laden’s eyes, Obama is a “murtad fitri”, the worst type of apostate, because he was blessed by Allah to be born into the true faith of Islam.
There are two types of apostates according to sharia (Islamic law) and the Hadith (sayings of the prophet Muhammad, peace be upon him).
The first type is “murtad milli”, one who converted to Islam and later renounced the faith. The second, and most egregious, type is “murtad fitri”. It refers to a person born of a Muslim father who renounces his birthright. Two recent examples of the latter are Magdi Allam (a male Egyptian who converted to Catholicism in Italy) and Ayaan Hirsi Ali (Somali-born woman who’s now an atheist). Both now face death threats.
According to Islamic jurisprudence, children of a Muslim father – even an apparently nonpracticing one, such as Obama’s father, and irrespective of the mother’s faith – are automatically Muslims. Most Muslims around the world agree: A child of a Muslim father is a Muslim. Period.
Should Obama become US commander in chief, there is a strong likelihood that Al Qaeda’s media arm, As-Sahab, will exploit his background to argue that an apostate is leading the global war on terror (read: attacks against fellow Muslims). This perception would be leveraged to galvanize sympathizers into action.
Remember: Al Qaeda’s ultimate goal is to restore the caliphate (the Islamic form of government that would preside over the community of believers) and expand Dar al Islam (”Abode of Islam”). Reaching it requires a long war against all – Muslim and non-Muslim – who don’t share its extremist Wahhabi worldview.
Al Qaeda, though, has struggled recently to recruit volunteers for this jihad. While bin Laden retains significant support as someone willing to stand up for Muslim concerns, most Muslims abhor Al Qaeda’s terrorist methods whose primary targets are innocent noncombatants.
But an apostate as head of the United States could change this equation. It would be a propaganda boost for Al Qaeda’s mission. All one has to do is read Al Qaeda’s public statements to recognize how frequently it makes baseless apostasy accusations against fellow Muslims who challenge its message or actions.
That’s why Obama is bin Laden’s dream candidate.
Once branded as an apostate, President Obama would face enormous difficulties in the foreign policy realm, especially in the fight against terrorism.
He’s caught between a rock and a hard place. If he softens the US strategy against Al Qaeda and its ideologues, his apostasy might be an afterthought for Al Qaeda. But if he acts firmly in America’s national interest to defeat the terrorist threat, he’d be vilified in an Al Qaeda propaganda campaign for reneging on his “true identity.”
Furthermore, his administration would struggle to positively engage the Muslim world, where Islam isn’t just a religion, it’s the way of life. Conservative Muslim populations that are riddled with poverty and low literacy rates can be more readily swayed to join the cause against the “Great Satan” (the US) if their imams and mullahs shout that it is led by an apostate.
Diplomacy is highly personal. The leaders of America’s Middle Eastern allies – such as Saudi Arabia, Kuwait, and Qatar – already feel besieged by jihadists and disgruntled citizens who see their governments as toadies of the West. The murtad card could intensify that pressure, so leaders of these countries might be compelled to distance themselves from Washington.
In short, an Obama presidency – which might be fine domestically – could have serious repercussions for US foreign interests at a time when it is especially vulnerable in a tight global oil market.
So far, Al Qaeda has been conspicuously quiet on Obama’s candidacy. But that should not come as a surprise. Hoping Obama gets elected, they’re probably waiting until he’s taken the oath of office to begin branding him a traitor to the faith of his fathers.
Islamic terrorists know that the long road to success lies in stoking the “clash of civilizations.” To reach their goal of restoring the Caliphate in a form that fits their worldview, they need massive numbers of Muslims to join their global jihad.
Bin Laden and his followers have already shown their willingness to exploit real or imagined religious schisms to expand their support base. So it’s not hard to imagine bin Laden praying that Obama wins this November.

Second point: If Obama holds/held dual citizenship, this could preclude him from the presidency. I have no prima facie evidence Obama is or was an Indonesian national, but there are legitimate questions being raised about his past. Campaigns are run on two levels: The positions of the candidates and the innuendo about the candidate. Innuendo has become much amplified since I was a kid and the web has certainly been a major contributor. Innuendo is very effective on a large percentage of the voting public who have neither the time or inclination to do their own due diligence or don’t have core beliefs.

So for me whether or not he is a ligit candidate doesn’t matter. Fundamentally I don’t like his positions or his lack of experience, and the rest is chopped liver.

Letting them cling to a preposterous claim that undermines their credibility and keeps them from undercutting him on serious issues is actually beneficial to his hopes of becoming President.

So by all means, keep attacking Obama because some “expert” who won’t even back up his claims with his real name says the COLB is fake, and that Barack was actually born in Prague to a minstrel’s daughter and rabid ferret.

Format example is: Selective Service Number 16-156-44-259 – Same is from New Orleans. Defined as: 16 is LA, 156 is the local board, and 1944 is his birth year. Note how low the local board’s selective service sequence — 259 — was in 1963.

That does NOT match the format of 61-1125539-1.

Jeez, will these stpid false rumors never cease? If all the Mc Cain camp has against Obama are these lies, then they really have got nothing!

Obama is a US citizen, has never been Moslem (covert or otherwise), he did register for selective service.

There are so many falsehoods and outright lies out there, that its difficult to dispell them in a short post.

I’m voting for Obama, rather than McCain, because I believe he is better qualified. The chief duty of Pres. is to protect the Constitution. Obama was a Constitutional lawyer and taught Constitutional law at the University of Chicago. McCain, on the other hand, participated in and endorsed Bush’s attack and dismantling of the Constitution.

National Security: Bush was originally criticized for having little Federal experience. The Republicans stated that Bush’s character was the essential component and he could get the expertise needed from his advisors. Well, Bush didn’t listen to any of his experts and advisors and that got us in this mess now. Obama doesn’t have that arrogance. He does have excellent advisors around him and he knows more about the Middle East thatn McCain and has more respect worldwide than McCain. That respect can forestall a lot of problems. McCain knows nothing about the Middle East, he has no experts around him, he’s too arrogant to listen to anyone. McCain does not know how to win wars, he knows how to lose them. Security does not mean going to war at the first problem. Obama clearly has the advantage here.

Ethics and Morals: Obama is ahead by a huge margin here. He has conducted himself honestly and openly throughut the campaign and his personal and private history. It would kill me to find out if he cheated on his wife, but so far he has no such scandals. He is a great family man and respects family values. He has not cheated nor lied about anything during the campaign. McCain has lied repeatedly about Obama, plaigarized his last speech (from Wikipedia of all places!), cheated on his wife and left her to marry a woman half his age. He repeatedlt turned his back on issues for the sake of political expediiency (such as being against torture than advocatng it-take a stand and stick to it man!). McCain has ties to organized crime and was involved in the Keating sca ndal.

Economy: Bush really screwed up the economy and we will get business as usual with MCain. He comes from a rich elitist background. He has no idea what struggling for a paycheck and to pay bills means. Now being rich does not exclude a person from understanding poverty. Many rich politicians can do it. Franklin Roosevelt for one. Gore could do it too. McCain displays no such empathy. He remains an old rich white dude that is ur of touch with the rest of America.

Obama grew up in poverty. He pulled himself up out of it. He knows what it takes to succeed. He’s a self made man.

First Lady: I cannot bring myself to put Cindy in White House. I know we vote for the Office, but she will be there representing America too. She was a convicted criminal. She was a drug addict who stole from charities to support her habit. She had an affair with a married man twice her age. I put her against Michell…a bright, honest woman. Not a breath of scandal around her. A good mother, a lawyer. She is also someone who dragged herself out of poverty and made something of her self. She’s a wonderful role model.

Incidently, I am not a party person. I’ve voted Republican as much as Democrat. I look at the man first, not the Party. I research for myself their postions and history. I don’t let Rush or Air America or anyone else tell me what to think. Nor do I pay attention to campaign ads.

Research for yourselves people! This is an important vote. Don’t base your vote on lies and innuendo.

Also it is odd considering, wasn’t Obama attending Occidential college in California when the registration allegedly occurred? Did he fly back to Home to register, missing classes (the semester had already started in August) just to “do the right thing?”

See, I too have been exchanging emails with Selective Service about this and was told “no release of information without a signed FOIA request.”

And my FOIA has not been returned yet.

Interesting that there is no date on that email either or data line. Not that an Obama drone would lie about their messiah!

I have done a little research, and it appears there IS a Daniel G. Amon of Alexandria, VA who at least as of 2004 was a GS-14 Public Afairs Specialist with the Selective Service System. This still does not answer the lingering questions about under what authority this information was released, and whether it is the “full story”. If not under a Freedom of Information Act request, there may not be a legal obligation to reveal all the details.

I’m especially curious about the careful wording of the email. It does not say Obama registered at a Hawaii post office in 1981, but that he registered there (maybe last week when he was on vacation , with an effective date of 1981. Kind of convoluted language.

What remains unanswered is under what authority the Obama registration info was obtained. If not under a Freedom of Information Act request, there may not be a a legal obligation to release the full story. The convoluted wording of the email is interesting. It does not say Obama registered in 1980, but that he registered in at a Hawaii post office (maybe last week when he was there on vacation , with an effective date of 1980. I myself have no doubt that Obama is a US citizen, but as in the case of the birth certificate, they raise lingering doubts but not releasing full unabridged documents when it eould be very simple to do so.

These rumors stick to Obama because there is some doubt about his honesty. He’s evasive and frequently needs to explain his own words, simply because he’s not clear about what he says. His behavior makes many people suspicious and that opens the door for all sorts of rumors. I neither believe or disbelieve the rumors until they are proven to be true or false.

As many people have stated, he may be eligible but he’s certainly not qualified. The exercise of investigating our candidates is a necessary freedom and I’m grateful to the bloggers and others who are doing the investigating. Let us not forget that John McCain’s eligibility based on place of birth has already been rumored out and proven beyond any doubt. Believe the rumors or not, or help to prove or disprove them, but don’t kill the messenger!

It’s mostly the mudslingers who are claiming that Obama was “raised by a single mother – in poverty.” I even saw one place today that his mom was 16. And mudslingers everywhere are trying to prove she wasn’t married–although the divorce papers are available. She was pregnant when she got married–and 18, and a college student. Her husband left her to attend Harvard Law School. His Mother married an Indonesian man, yes, and dragged poor Barry to Indonesia, yes. Her new husband worked for Shell Oil. At first they lived in a poor part of town, and Obama attended a Catholic school. Later, as his stepdad advanced in the oil buisness, they moved and he attended a public school close to their new home for two years. Then his mom and his stepfather divorced. Since his mom was doing graduate work in Indonesia, she couldn’t leave right away. But Obama had received a scholarship in a very good school back in Hawaii (started for missionary children)so she took him back there to stay with his grandparents until she could return. She did return, but had to go back to Indonesia to finish her graduate dissertation. Obama decided to stay in Hawaii and keep attending his very nice school. From then on, yes, he pretty much lived with his grandparents in a pretty nice home (his grandmother was the vice-president of a bank) NOT single and he lived a comfortable lifestyle and attended an exclusive private school.Then he went to Columbia University, then to Harvard, where he was the first black President of the Harvard Review.

I like Obama. I didn’t know at first, until I had researched him and found out about him. Now I feel very comfortable about him. I created http://obamascrapbook to share my research with others. I’m just an ex-Hillary supporter (actually I really like Biden and hope he gets tagged for VP), who had to find out for herself who this guy was.

The child of an American citizen is automatically an American citizen by American law, regardless of the law where the child was born. **This applies to both Candidate Obama and Candidate McCain, each of whom had at least one American parent.** However, if that child is not born on American territory (which includes American embassies, territories and military bases), the child’s child must be born on American territory to automatically receive American citizenship. **If John McCain was born on the American base in Panama, he was born on American territory, and need not have worried where his children were born, but it did not affect his own citizenship.** Thus, trailing daughter #2, who was born in a German hospital, is an American citizen, although she was issued a German birth certificate. I had to show her birth certificate, and mine, and my American passport, to the officials at the American embassy in Frankfurt, in order to get from them a certificate of birth, enabling me to get into the next line to get td #2 an American passport. The photo is interesting — the child couldn’t yet hold up her head, and she desperately wanted a nap. Thank goodness children’s passports must be renewed every five years!

At any rate, trailing daughter #2 must return to the U.S. or an American territory to give birth to her children, unless her husband is an American citizen born on American territory, which would make her issues moot.

It’s possible that Barack Obama, Senior decided to register his son’s birth in Kenya, which I suppose could give Candidate Obama dual citizenship. But I agree with those who think Candidate Obama fails on the merits, not these pettifogging details. It would be easy enough to send someone to Kenya to check the records — I imagine that as a former colony of Britain, Kenya follows British practice of recording all births, marriages and deaths in a single office in the capitol. At any rate, as an educated and semi-important member of the ruling elite of Kenya (although of a tribe intermittently out of power), I’m sure Barack Obama, Senior would have made sure to register his son properly, had he done so at all.

That Muslims abroad consider Candidate Obama to be automatically a Muslim, whether now secret or apostate, does have implications for his effectiveness in that part of the world once in office. On the other hand, it would certainly be an object lesson for such people when their expectations for his actions turn out to be severely constrained by a Congress and Supreme Court which are not in the least bit Muslim.

Since when does the US government release information about a person without authorization? Even information as inocuous as the date and place of SS registration?

Did Obama fill out a SF-180 and authorize release of these materials? Did he authorize release of the information pertaining to any passports issued in his name?

That adoption/name change business could be put to rest easily with an examination of the passport application that was made for him (perhaps on his mother’s passport) to travel to his home in Jakarta.

If he travelled to Indonesia as Barry Soetoro, then he, or his mother, did change his name. If he did change it, and change it back again, he should have noted that on his application for a law license.

Apparently it’s OK to make up “facts” about the law regarding birth certificates, adoption, selective service registration, and so forth. When we were 10-year-olds at summer camp, it was fine to say “Ya know what I heard? I heard there was this guy with a hook for a hand, and just 3 miles from here, he…” and so on. It was fun, and we were young and dumb. But now we are adults; we have left childish things behind. A fellow named JP Becker states that “Obama’s draft registration [is] phony.” He says that Obama was in class at Occidental on 9/4/80. Do you have a source for that? Just kinda making it up? I’m guessing that you heard it somewhere. Maybe got it in an email. Why should we believe it? When I was in high school, we had to support the things we said. Otherwise our work came back with red ink: “Support?” I hereby red-ink the comments on this page. Y’all need a lesson in critical thinking.

By the way, if you can’t come up with facts to support your case, I gotta wonder about your case.

Even if true this would not disqualify Obama from being President – Congress can’t impose additional requirements to hold the office other than what are already in the Constitution.
Further, if this were not the case it would be a bad idea to use the failure to file a piece of paper 30 years ago to legally disqualify someone.
Additionally I suspect these conspiracy-type arguments don’t play well politically – given his vulnerability on his policy positions (taxes, national security, 2nd amendment, etc.), associates (Rezko, Ayers, Wright), limited experience and poor judgment dredging up and basing the case against Obama on this issue is really a poor idea.

(2) With the exception in the verse one above, a foreign woman that married to Indonesian will be granted as Indonesian a year after her married, if within a year her husband not declare to withdrawn his Indonesian nationality. That declaration only could be declare and only make he lost his nationality, in which the husband shall not become had no nationality at all.
(3) If one of those declaration that being said before on verse 1 and 2 is already been declared then other’s must not be declare at all.

(4) Those announcement/declaration must be pronounced before the court or other Indonesian Representative on the area of that person was living.

(1) A foreign child below age of 5 that been adopted by Indonesian shall be granted Indonesian citizenship, if the court said this is legal on the same juridiction on where the adpted parents lives.

Undang-undang tentang Kewarganegaraan Republik Indonesia.

Pasal 1.

Warga-negara Republik Indonesia ialah:
a. orang-orang yang berdasarkan perundang-undangan dan/atau perjanjian-perjanjian dan/atau peraturan-peraturan yang berlaku sejak proklamasi 17 Agustus 1945 sudah warga-negara Republik Indonesia;
b. orang yang pada waktu lahirnya mempunyai hubungan hukum kekeluargaan dengan ayahnya, seorang warga-negara Republik Indonesia, dengan pengertian bahwa kewarga-negaraan Republik Indonesia tersebut dimulai sejak adanya hubungan hukum kekeluargaan termaksud, dan bahwa hubungan hukum kekeluargaan ini diadakan sebelum orang itu berumur 18 tahun atau sebelum ia kawin pada usia di bawah 18 tahun;
c. anak yang lahir dalam 300 hari setelah ayahnya meninggal dunia, apabila ayah itu pada waktu meninggal dunia warga- negara Republik Indonesia;
d. orang yang pada waktu lahirnya ibunya warga-negara Republik Indonesia, apabila ia pada waktu itu tidak mempunyai hubungan hukum kekeluargaan dengan ayahnya;
e. orang yang pada waktu lahirnya ibunya warga-negara Republik Indonesia, jika ayahnya tidak mempunyai kewarga-negaraan, atau selama tidak diketahui kewarga-negaraan ayahnya;
f. orang yang lahir di dalam wilayah Republik Indonesia selama kedua orang tuanya tidak diketahui;
g. seorang anak yang diketemukan di dalam wilayah Republik Indonesia selama tidak diketahui kedua orang tuanya;
h. orang yang lahir di dalam wilayah Republik Indonesia, jika kedua orang tuanya tidak mempunyai kewarga-negaraan atau selama kewarga-negaraan kedua orang tuanya tidak diketahui;
i. orang yang lahir di dalam wilayah Republik Indonesia yang pada waktu lahirnya tidak mendapat kewarga-negaraan ayah atau ibunya dan selama ia tidak mendapat kewarganegaraan ayah atau ibunya itu;
j. orang yang memperoleh kewarga-negaraan Republik Indonesia menurut aturan-aturan Undang-undang ini.

Pasal 2.

(1) Anak asing yang belum berumur 5 tahun yang diangkat oleh seorang warga-negara Republik Indonesia, memperoleh kewarganegaraan Republik Indonesia, apabila pengangkatan itu dinyatakan sah oleh Pengadilan Negeri dari tempat tinggal orang yang mengangkat anak itu.

(2) Pernyataan sah oleh Pengadilan Negeri termaksud harus dimintakan oleh orang yang mengangkat anak tersebut dalam 1 tahun setelah pengangkatan itu atau dalam 1 tahun setelah Undang-undang ini mulai berlaku.

Pasal 3.

(1) Anak di luar perkawinan dari seorang ibu warga-negara Republik Indonesia atau anak dari perkawinan sah, tetapi dalam perceraian oleh hakim anak tersebut diserahkan pada asuhan ibunya seorang warga-negara Republik Indonesia, yang kewarga-negaraannya turut ayahnya seorang asing, boleh mengajukan permohonan kepada Menteri Kehakiman untuk memperoleh kewarga-negaraan Republik Indonesia tidak mempunyai kewarga-negaraan lain atau menyertakan pernyataan menanggalkan kewarganegaraan lain menurut cara yang ditentukan oleh ketentuan hukum dari negara asalnya dan/atau menurut cara yang ditentukan oleh perjanjian penyelesaian dwikewarga-negaraan antara Republik Indonesia dan negara yang bersangkutan.

(2) Permohonan tersebut di atas harus diajukan dalam 1 tahun sesudah orang yang bersangkutan berumur 18 tahun kepada Menteri Kehakiman melalui Pengadilan Negeri atau Perwakilan Republik Indonesia dari tempat tinggalnya.

(3) Menteri Kehakiman mengabulkan atau menolak permohonan itu dengan persetujuan Dewan Menteri.

(4) Kewarga-negaraan Republik Indoenesia yang diperoleh atas permohonan itu mulai berlaku pada hari tanggal keputusan Menteri Kehakiman.

Pasal 4.

(1) Orang asing yang lahir dan bertempat tinggal di dalam wilayah Republik Indonesia yang ayah-atau ibunya, apabila ia tidak mempunyai hubungan hukum kekeluargaan dengan ayahnya, juga lahir di dalam wilayah Republik Indonesia dan penduduk Republik Indonesia, boleh mengajukan permohonan kepada Menteri Kehakiman untuk memperoleh kewarga-negaraan Republik Indonesia, apabila ia setelah memperoleh kewarga-negaraan Republik Indonesia tidak mempunyai kewarga-negaraan lain, atau pada saat mengajukan permohonan ia menyampaikan juga surat pernyataan menanggalkan kewarga-negaraan lain yang mungkin dimilikinya sesuai dengan ketentuan-ketentuan hukum yang berlaku di negara asalnya atau sesuai dengan ketentuan-ketentuan di dalam perjanjian penyelesaian dwi-kewarga-negaraan antara Republik Indonesia dan negara yang bersangkutan.

(2) Permohonan tersebut di atas harus diajukan dalam 1 tahun sesudah orang yang bersangkutan berumur 18 tahun kepada Menteri Kehakiman melalui Pengadilan Negeri dari tempat tinggalnya.

(3) Menteri Kehakiman mengabulkan atau menolak permohonan itu dengan persetujuan Dewan Menteri.

(4) Kewarga-negaraan Republik Indonesia yang diperoleh atas permohonan itu mulai berlaku pada hari tanggal keputusan Menteri Kehakiman.

Pasal 5.

(1) Kewarga-negaraan Republik Indonesia karena pewarga-negaraan diperoleh dengan berlakunya keputusan Menteri Kehakiman yang memberikan pewarganegaraan itu.

(2) Untuk mengajukan permohonan pewarga-negaraan pemohon harus:
a sudah berumur 21 tahun;
b. lahir dalam wilayah Republik Indonesia, atau pada waktu mengajukan permohonan bertempat tinggal dalam daerah itu selama sedikit-dikitnya 5 tahun berturut-turut yang paling akhir atau sama sekali selama 10 tahun tidak berturut-turut;
c. apabila ia seorang laki-laki yang kawin-mendapat persetujuan isteri (isteri-isteri)nya;
d. cukup dapat berbahasa Indonesia dan mempunyai sekedar pengetahuan tentang sejarah Indonesia serta tidak pernah dihukum karena melakukan kejahatan yang merugikan Republik Indonesia;
e. dalam keadaan sehat rokhani dan jasmani;
f. membayar pada Kas Negeri uang sejumlah antara Rp. 500,- sampai Rp. 10.000,- yang ditentukan besarnya oleh Jawatan Pajak tempat tinggalnya berdasarkan penghasilannya, tiap bulan yang nyata dengan ketentuan tidak boleh melebihi penghasilan nyata sebulan;
g. mempunyai mata pencaharian yang tetap,
h. tidak mempunyai kewarga-negaraan, atau kehilangan kewarga-negaraannya apabila ia memperoleh kewarga-negaraan Republik Indonesia atau menyertakan pernyataan menanggalkan kewarga-negaraan lain menurut ketentuan hukum dari negara asalnya atau menurut ketentuan hukum perjanjian penyelesaian dwi-kewarganegaraan antara Republik Indonesia dan negara yang bersangkutan.
Seorang perempuan selama dalam perkawinan tidak boleh mengajukan permohonan pewarga-negaraan.

(3) Permohonan untuk pewarga-negaraan harus disampaikan dengan tertulis dan dibubuhi meterai kepada Menteri Kehakiman melalui Pengadilan Negeri atau Perwakilan Republik Indonesia dari tempat tinggal pemohon;
Permohonan harus ditulis dalam bahasa Indonesia dan bersama dengan permohonan itu harus disampaikan bukti-bukti tentang hal-hal tersebut dalam ayat 2 kecuali yang tersebut dalam huruf d.
Pengadilan Negeri atau perwakilan Republik Indonesia memeriksa bukti-bukti itu akan kebenarannya dan menguji pemohon akan kecakapannya berbahasa Indonesia dan akan pengetahuannya tentang sejarah Indonesia.

(4) Menteri Kehakiman mengabulkan atau menolak permohonan pewarga-negaraan dengan persetujuan Dewan Menteri.

(5) Keputusan Menteri Kehakiman yang memberikan pewarganegaraan mulai berlaku pada hari pemohon dihadapan Pengadilan Negeri atau perwakilan Republik Indonesia dari tempat tinggalnya mengucapkan sumpah atau janji setia dan berlaku surut hingga dari tanggal keputusan Menteri Kehakiman tersebut.

Sumpah atau janji setia itu adalah seperti berikut: “Saya bersumpah (berjanji): bahwa saya melepaskan seluruhnya, segala kesetiaan kepada kekuasaan asing: bahwa saya mengaku dan menerima kekuasaan yang tertinggi dari Republik Indonesia dan akan menepati kesetiaan kepadanya: bahwa saya akan menjunjung tinggi Undang-undang Dasar dan hukum-hukum Republik Indonesia dan akan membelanja dengan sungguh-sungguh: bahwa saya memikul kewajiban ini dengan rela hati dan tidak akan mengurangi sedikitpun”.

(6) Setelah pemohon mengucapkan sumpah atau janji setia termaksud di atas. Menteri Kehakiman mengumumkan pewarganegaraan itu dengan menempatkan keputusannya dalam Berita-Negara.

(7) Apabila sumpah atau janji setia tidak diucapkan dalam waktu tiga bulan setelah hari tanggal keputusan Menteri Kehakiman, maka keputusan itu dengan sendirinya menjadi batal.

(8) Jumlah uang tersebut dalam ayat 2 dibayarkan kembali, apabila permohonan pewarga-negaraan tidak dikabulkan.

(9) Jika permohonan pewarga-negaraan ditolak, maka pemohon dapat mengajukan permohonan kembali.

Pasal 6.

Pewarga-negaraan juga dapat diberikan dengan alasan kepentingan negara atau telah berjasa terhadap negara oleh Pemerintah dengan persetujuan Dewan Perwakilan Rakyat.
Dalam hal ini dari ketentuan-ketentuan dalam pasal 5 hanya berlaku ketentuan-ketentuan ayat 1, ayat 5, ayat 6 dan ayat 7.

Pasal 7.

(1) Seorang perempuan asing yang kawin dengan seorang warga-negara Republik Indonesia, memperoleh kewarga-negaraan Republik Indonesia, apabila dan pada waktu ia dalam 1 tahun setelah perkawinannya berlangsung menyatakan keterangan untuk itu, kecuali jika ia apabila memperoleh kewarga-negaraan Republik Indonesia masih mempunyai kewarga-negaraan lain, dalam hal mana keterangan itu tidak boleh dinyatakan.(1) Seorang perempuan asing yang kawin dengan seorang warga-negara Republik Indonesia, memperoleh kewarga-negaraan Republik Indonesia, apabila dan pada waktu ia dalam 1 tahun setelah perkawinannya berlangsung menyatakan keterangan untuk itu, kecuali jika ia apabila memperoleh kewarga-negaraan Republik Indonesia masih mempunyai kewarga-negaraan lain, dalam hal mana keterangan itu tidak boleh dinyatakan.

(2) Dengan kekecualian tersebut dalam ayat 1 perempuan asing yang kawin dengan seorang warga-negara Republik Indonesia juga memperoleh kewarga-negaraan Republik Indonesia satu tahun sesudah perkawinannya berlangsung, apabila dalam satu tahun itu suaminya tidak menyatakan keterangan untuk melepaskan kewarga-negaraan Republik Indonesia.
Keterangan itu hanya boleh dinyatakan dan hanya mengakibatkan hilangnya kewarga-negaraan Republik Indonesia, apabila degan kehilangan itu suami tersebut tidak menjadi tanpa kewarganegaraan.

(3) Apabila salah satu dari keterangan tersebut dalam ayat 1 dan 2 sudah dinyatakan, maka keterangan yang lainnya tidak boleh dinyatakan.

(4) Keterangan-keterangan tersebut di atas harus dinyatakan kepada Pengadilan Negeri atau Perwakilan Republik Indonesia dari tempat tinggal orang yang menyatakan keterangan itu.

Pasal 8.

(1) Seorang perempuan warga-negara Republik Indonesia yang kawin dengan seorang asing kehilangan kewarga-negaraan Republik Indonesianya, apabila dan pada waktu ia dalam 1 tahun setelah perkawinannya berlangsung menyatakan keterangan untuk itu, kecuali apabila ia dengan kehilangan kewarga-negaraan Republik Indonesia itu menjadi tanpa kewarga-negaraan.

(2) Keterangan tersebut dalam ayat 1 harus dinyatakan kepada Pengadilan Negeri atau Perwakilan Republik Indonesia dari tempat tinggal orang yang menyatakan keterangan itu.

Pasal 9.

(1) Kewarga-negaraan Republik Indonesia yang diperoleh oleh seoang suami dengan sendirinya berlaku terhadap isterinya, kecuali apabila setelah memperoleh kewarga-negaraan Republik Indonesia isteri itu masih mempunyai kewarga-negaraan lain.

(2) Kehilangan kewarga-negaraan Republik Indonesia oleh seorang suami dengan sendirinya berlaku terhadap isterinya, kecuali apabila suami itu akan menjadi tanpa kewarga-negaraan.

Pasal 10.

(1) Seorang perempuan dalam perkawinan tidak boleh mengajukan permohonan tersebut dalam pasal 3 dan pasal 4.

(2) Kehilangan kewarga-negaraan Republik Indonesia oleh seorang isteri dengan sendirinya berlaku terhadap suaminya, kecuali apabila suami itu akan menjadi tanpa kewarga-negaraan.

Pasal 11.

(1) Seorang yang disebabkan oleh atau sebagai akibat dari perkawinannya kehilangan kewarga-negaraan Republik Indonesia, memperoleh kewarga-negaraan itu kembali jika dan pada waktu ia setelah perkawinannya terputus menyatakan keterangan untuk itu.
Keterangan itu harus dinyatakan dalam waktu 1 tahun setelah perkawinan itu terputus kepada Pengadilan Negeri atau kepada Perwakilan Republik Indonesia dari tempat tinggalnya.

(2) Ketentuan ayat 1 tidak berlaku dalam hal orang itu apabila setelah memperoleh kembali kewarga-negaraan Republik Indonesia masih mempunyai kewarga-negaraan lain.

Pasal 12.

(1) Seorang perempuan yang disebabkan oleh atau sebagai akibat perkawinannya memperoleh kewarga-negaraan Republik Indonesia, kehilangan kewarga-negaraan itu lagi, jika dan pada waktu ia setelah perkawinannya terputus menyatakan keterangan untuk itu.
Keterangan itu harus dinyatakan dalam waktu 1 tahun setelah perkawinan itu terputus kepada Pengadilan Negeri atau Perwakilan Republik Indonesia dan tempat tinggalnya.

(2) Ketentuan ayat 1 tidak berlaku apabila orang itu dengan kehilangan kewarga-negaraan Republik lndonesianya menjadi tanpa kewarga-negaraan.

Pasal 13.

(1) Anak yang belum berumur 18 tahun dan belum kawin yang mempunyai hubungan hukum kekeluargaan dengan ayahnya sebelum ayah itu memperoleh kewarga-negaraan Republik Indonesia, turut memperoleh kewarga-negaraan Republik Indonesia setelah ia bertempat tinggal dan berada di Indonesia. Keterangan tentang bertempat tinggal dan berada di Indonesia itu tidak berlaku terhadap anak-anak yang karena ayahnya memperoleh kewarga-negaraan Republik Indonesia menjadi tanpa kewarga-negaraan.

(2) Kewarga-negaraan Republik Indonesia yang diperoleh seorang ibu berlaku juga terhadap anak-anaknya yang tidak mempunyai hubungan hukum kekeluargaan dengan ayahnya, yang belum berumur 18 tahun dan belum kawin setelah mereka bertempat tinggal dan berada di Indonesia.
Apabila kewarga-negaraan Republik Indonesia itu diperoleh dengan pewarga-negaraan oleh seorang ibu yang telah menjadi janda karena suaminya meninggal maka anak-anak yang mempunyai hubungan hukum kekeluargaan dengan suami itu, yang belum berumur 18 tahun dan belum kawin turut memperoleh kewarga-negaraan Republik Indonesia juga, setelah mereka bertempat tinggal dan berada di Indonesia.
Keterangan tentang tempat tinggal dan berada di Indonesia itu tidak berlaku terhadap anak-anaknya yang karena ibunya memperoleh kewarga-negaraan Republik Indonesia menjadi tanpa kewarga-negaraan.

Pasal 14.

(1) Bilamana anak termaksud dalam pasal 2 dan pasal 13 sampai berumur 21 tahun, maka ia kehilangan kewarga-negaraan Republik Indonesia lagi, jika dan pada waktu ia menyatakan keterangan untuk itu.
Keterangan itu harus dinyatakan dalam waktu 1 tahun setelah anak itu berumur 21 tahun kepada Pengadilan Negeri atau Perwakilan Republik Indonesia dari tempat tinggalnya.

(2) Ketentuan ayat 1 tidak berlaku apabila anak itu dengan kehilangan kewarga-negaraan Republik Indonesianya menjadi tanpa kewarga-negaraan.

Pasal 15.

(1) Kehilangan kewarga-negaraan Republik Indonesia oleh seorang ayah berlaku juga terhadap anak-anaknya yang mempunyai hubungan hukum kekeluargaan dengan ayah itu, yang belum berumur 18 tahun dan belum kawin, kecuali jika dengan kehilangan kewarga-negaraan Republik Indonesia anak-anak itu menjadi tanpa kewarga-negaraan.

(2) Kehilangan kewarga-negaraan Republik Indonesia oleh seorang ibu berlaku juga terhadap anak-anaknya yang tidak mempunyai hubungan hukum kekeluargaan dengan ayahnya, kecuali jika dengan kehilangan kewarga-negaraan Republik Indonesia anak-anak itu menjadi tanpa kewarga-negaraan.

(3) Apabila ibu itu kehilangan kewarga-negaraan Republik Indonesia karena pewarga-negaraan di luar negeri dan ibu itu telah menjadi janda karena suaminya meninggal, maka ketentuan- ketentuan dalam ayat 2 berlaku juga terhadap anak-anaknya yang mempunyai hubungan hukum kekeluargaan dengan suami itu, setelah anak-anak itu bertempat tinggal dan berada di luar negeri.

Pasal 16.

(1) Seorang anak yang kehilangan kewarga-negaraan Republik Indonesianya karena ayah atau ibunya kehilangan kewarga-negaraan itu, memperoleh kewarga-negaraan Republik Indonesia kembali setelah anak tersebut sampai berumur 18 tahun, jika dan pada waktu itu menyatakan keterangan untuk itu.
Keterangan termaksud harus dinyatakan dalam waktu 1 tahun setelah anak itu berumur 18 tahun kepada Pengadilan Negeri atau Perwakilan Republik Indonesia dari tempat tinggalnya.

(2) Ketentuan ayat 1 tidak berlaku dalam hal anak itu – apabila setelah memperoleh kewarga-negaraan Republik Indonesia – masih mempunyai kewarga-negaraan lain.

Pasal 17.

Kewarga-negaraan Republik Indonesia hilang karena:
a. memperoleh kewarga-negaraan lain karena kemauannya sendiri, dengan pengertian bahwa jikalau orang yang bersangkutan pada waktu memperoleh kewarga-negaraan lain itu berada dalam wilayah Republik Indonesia kewarga-negaraan Republik Indonesianya baru dianggap hilang apabila Menteri Kehakiman dengan persetujuan Dewan Menteri atas kehendak sendiri atau atas permohonan orang yang bersangkutan menyatakannya hilang;
b. tidak menolak atau melepaskan kewarga-negaraan lain, sedang- kan orang yang bersangkutan mendapat kesempatan untuk itu;
c. diakui oleh orang asing sebagai anaknya, jika orang yang bersangkutan belum berumur 18 tahun dan belum kawin dan dengan kehilangan kewarga-negaraan Republik Indonesia tidak menjadi tanpa kewarga-negaraan;
d. anak yang diangkat dengan sah oleh orang asing sebagai anaknya, jika anak yang bersangkutan belum berumur 5 tahun dan dengan kehilangan kewarga-negaraan Republik Indonesia tidak menjadi tanpa kewarga-negaraan;
e. dinyatakan hilang oleh Menteri Kehakiman dengan persetujuan Dewan Menteri atas permohonan orang yang bersangkutan, jika ia telah berumur 21 tahun, bertempat tinggal di luar negeri dan dengan dinyatakan hilang kewarga-negaraan Republik lndonesianya tidak menjadi tanpa kewarga-negaraan;
f. masuk dalam dinas tentara asing tanpa izin terlebih dahulu dari Menteri Kehakiman;
g. tanpa izin terlebih dahulu dari Menteri Kehakiman masuk dalam dinas negara asing atau dinas suatu organisasi antar negara yang tidak dimasuki oleh Republik Indonesia sebagai anggota, Jika jabatan dinas negara yang dipangkunya menurut peraturan Republik Indonesia hanya dapat dipangku oleh warga-negara atau jabatan dalam dinas organisasi antar negara tersebut memerlukan sumpah atau janji jabatan;
h. mengangkat sumpah atau menyatakan janji setia kepada negara asing atau bagian dari padanya;
i. dengan tidak diwajibkan, turut-serta dalam pemilihan sesuatu yang bersifat ketata-negaraan untuk suatu negara asing;
j. mempunyai paspor atau surat yang bersifat paspor dari negara asing atas namanya yang masih berlaku;
k. lain dari untuk dinas negara, selama 5 tahun berturut-turut bertempat tinggal di luar negeri dengan tidak menyatakan keinginannya untuk tetap menjadi warga-negara sebelum waktu itu lampau dan seterusnya tiap-tiap dua tahun; keinginan itu harus dinyatakan kepada Perwakilan Republik Indonesia dari tempat tinggalnya.
Bagi warga-negara Republik Indonesia yang berumur di bawah 18 tahun terkecuali apabila ia sudah pernah kawin, masa lima dan dua tahun tersebut di atas mulai berlaku pada hari tanggal ia mencapai umur 18 tahun.

Seorang yang kehilangan kewarga-negaraan Republik Indonesia termaksud dalam pasal 17 huruf k memperoleh kewarga-negaraan Republik Indonesia kembali jika ia bertempat tinggal di Indonesia berdasarkan Kartu Izin Masuk dan menyatakan keterangan untuk itu.
Keterangan itu harus dinyatakan kepada Pengadilan Negeri dari tempat tinggalnya dalam 1 tahun setelah orang itu bertempat tinggal di Indonesia.

Pasal 19.

Kewarga-negaraan Republik Indonesia yang diberikan atau diperoleh atas keterangan-keterangan yang tidak benar dapat dicabut kembali oleh instansi yang memberikannya atau oleh instansi yang menerima keterangan-keterangan itu.

Pasal 20.

Barangsiapa bukan warga-negara Republik Indonesia adalah orang asing.

PERATURAN PERALIHAN.

Pasal I.

Seorang perempuan yang berdasarkan pasal 3 Peraturan Penguasa Militer No. Prt/PM/09/1957 dan pasal 3 Peraturan Penguasa Perang Pusat No. Prt/Peperpu/0 14/1958 telah diperlakukan sebagai warga-negara Republik Indonesia, menjadi warga-negara Republik Indonesia, apabila ia tidak mempunyai kewarga-negaraan lain.

Pasal II.

Seorang yang pada waktu Undang-undang ini mulai berlaku berada dalam keadaan tertera dalam pasal 7 atau pasal 8, dapat menyatakan keterangan tersebut dalam pasal-pasal itu dalam waktu 1 tahun sesudah mulai berlakunya Undang-undang ini, dengan pengertian bahwa suami seorang perempuan yang menjadi warga- negara Republik Indonesia termaksud dalam pasal 1 peraturan- peralihan tidak dapat menyatakan keterangan tersebut dalam pasal 7 ayat 2 lagi.

Pasal III.

Seorang perempuan yang menurut perundang-undangan yang berlaku sebelum Undang-undang ini mulai berlaku dengan sendirinya warga-negara Republik Indonesia seandainya ia tidak dalam perkawinan, memperoleh kewarga-negaraan Republik Indonesia, jika dan pada waktu ia dalam 1 tahun setelah perkawinannya terputus atau dalam 1 tahun setelah Undang-undang ini mulai berlaku menyatakan keterangan untuk itu kepada Pengadilan Negeri atau kepada Perwakilan Republik Indonesia dari tempat tinggalnya.

Pasal IV.

Seorang yang tidak turut dengan ayahnya atau ibunya memperoleh kewarga-negaraan Republik Indonesia dengan pernyataan keterangan menurut perundang-undangan yang berlaku sebelum Undang-undang ini berlaku, karena orang itu pada waktu ayahnya atau ibunya menyatakan keterangan itu sudah dewasa, sedangkan ia sendiri tidak boleh menyatakan keterangan memilih kewarga-negaraan Republik Indonesia, adalah warga-negara Republik Indonesia jika ia dengan ketentuan ini atau sebelumnya tidak mempunyai kewarga-negaraan lain.
Kewarga-negaraan Republik Indonesia yang diperoleh orang tersebut berlaku surut hingga waktu ayah/ibunya memperoleh kewarga-negaraan itu.

Pasal V.

Menyimpang dari ketentuan-ketentuan pasal 4 ayat 1 dan 2 anak-anak yang antara tanggal 27 Desember 1949 sampai 27 Desember 1951 oleh orang tuanya ditolakkan kewarga-negaraan Republik Indoensianya, dalam tempo satu tahun setelah Undang-undang ini mulai berlaku, dapat mengajukan permohonan kepada Menteri Kehakiman melalui Pengadilan Negeri dari tempat tinggalnya untuk memperoleh kewarga-negaraan Republik Indonesia, apabila ia berusia di bawah 28 tahun; selanjutnya berlaku pasal 4 ayat 3 dan 4.

Pasal VI.

Seorang asing yang sebelum Undang-undang ini mulai berlaku pernah masuk dalam ketentaraan Republik Indonesia dan memenuhi syarat-syarat yang akan ditentukan oleh Menteri Pertahanan, memperoleh kewarga-negaraan Republik Indonesia jika ia menyatakan keterangan untuk itu kepada Menteri Pertahanan atau kepada pejabat yang ditunjuk olehnya.
Kewarga-negaraan Republik Indonesia yang diperoleh orang tersebut di atas berlaku surut hingga saat orang itu masuk dalam ketentaraan itu.
Pasal VII.

Seorang yang sebelum Undang-undang ini mulai berlaku berada dalam dinas tentara asing termaksud dalam pasal 17 huruf f atau berada dalam dinas negara asing atau dinas suatu organisasi antar negara dimaksud dalam pasal 17 huruf g, dapat minta izin kepada Menteri Kehakiman dalam waktu 1 tahun setelah Undang-undang ini mulai berlaku.

PERATURAN PENUTUP.

Pasal I.

Seorang warga-negara Republik Indonesia yang berada dalam wilayah Republik Indonesia dianggap tidak mempunyai kewarga- negaraan lain.

Pasal II.

Dalam pengertian kewarga-negaraan termasuk semua jenis lindungan oleh sesuatu negara.

Pasal III.

Dalam melakukan Undang-undang ini anak yang belum berumur 18 tahun dan belum kawin dianggap turut bertempat tinggal dengan ayah atau ibunya menurut perincian dalam pasal 1 huruf b, c atau d.

Pasal IV.

Barangsiapa perlu membuktikan bahwa ia warga-negara Republik Indonesia dan tidak mempunyai surat bukti yang menunjukkan bahwa ia mempunyai atau memperoleh atau turut mempunyai atau turut memperoleh kewarga-negaraan itu, dapat minta kepada Pengadilan Negeri dari tempat tinggalnya untuk menetapkan apakah ia warga-negara Republik Indonesia atau tidak menurut acara perdata biasa.
Ketentuan ini tidak mengurangi ketentuan-ketentuan khusus dalam atau berdasarkan Undang-undang lain.

Pasal V.

Dari pernyataan-pernyataan keterangan yang menyebabkan diperolehnya atau hilangnya kewarga-negaraan Republik Indonesia, oleh pejabat yang bersangkutan disampaikan salinan kepada Menteri Kehakiman.

Pasal VI.

Menteri Kehakiman mengumumkan dalam Berita-Negara nama-nama orang yang memperoleh atau kehilangan kewarga-negaraan Republik Indonesia.

Pasal VII.

Segala sesuatu yang diperlukan untuk melaksanakan ketentuan-ketentuan Undang-undang ini diatur dengan Peraturan Pemerintah.

Pasal VIII.

Undang-undang ini mulai berlaku pada hari diundangkan dengan ketentuan bahwa aturan-aturan pasal 1 huruf b sampai huruf j, pasal 2, pasal 17 huruf a, c dan h berlaku surut hingga tanggal 27 Desember 1949.

Agar supaya setiap orang dapat mengetahuinya, memerintahkan pengundangan Undang-undang ini dengan penempatan dalam Lembaran-Negara Republik Indonesia.

That is an old trick used by anti-war activists. The law requires men to register from age 18 to 25. If a man registers, say, at age 21 or older, his chances of being drafted are far less.

He has no security clearance. Can we afford to trust the decisions of a president who has forged documents to appear eligible to be president and has spent over $800,000, of I do not know whose money, to keep from showing his identity and eligibility?
