		<description>There are a lot of things that worry me about Democratic control of the country, but The Fairness Doctrine isn&#039;t one of them. The FD is such a blatant attempt to silence opposition that it wouldn&#039;t survive litigation. And while it was tied up in the courts, the fight over it would galvanize conservatives, pour money into the GOP, provide tons of free publicity and hero-status to talkers, and embarrass the small but significant number of liberals who really do value civil liberties. I doubt Obama really wants to be publicly rebuked by at least 5 SCOTUS judges for a forray into fascism. 
Even if it was somehow upheld, it would become moot as the AM radio is replaced by the streaming audio player anyway. Rush and Sean could broadcast to the entire country from a server in Greenland, and no FD could stop it. 
Also, even though they&#039;re in the tank for the Democrats, I don&#039;t think the news networks would support the FD. The Democrats have already shown a willingness to go after any of the major networks to suppress documentaries they don&#039;t like. They&#039;ve even threatened PBS! And imagine what could happen when Republicans eventually regain power, and have a legislative tool that could be applied to CBS or NPR with a bit of retooling. 
I caught a little bit of Rush today (confession: I find talk radio boring for the most part) but the guy really doesn&#039;t sound worried. He knows.</description>
